1. Acceptance of These Terms

Welcome to the website of Images by Kristen. This website at https://imagesbykristen.com/ (the “Site”) is operated by Sweetie Pea, Inc., a California corporation doing business as Images by Kristen (“Images by Kristen,” “we,” “us,” or “our”), a real estate and aerial photography business based in Los Angeles County, California. These Terms of Use (“Terms”) govern your access to and use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Our Privacy Policy explains how we collect and use information through the Site and is incorporated into these Terms by reference.

2. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page. The effective date at the top shows the current version. Your continued use of the Site after changes are posted means you accept the updated Terms.

3. Use of the Site; Eligibility

The Site is provided for your personal and business use — to view our photography portfolio, review our services and pricing, and contact us about a project. By using the Site, you represent that you are at least 18 years old or are using the Site under the supervision of a parent or legal guardian.

4. Services, Pricing, and Inquiries

The Site describes our photography services — including residential real estate photography, drone/aerial photography and video, twilight photography, floor plans, and virtual walk-throughs — and lists example pricing. Pricing on the Site is for general reference only: prices, packages, and availability may change without notice, custom quotes are prepared per project, and posted prices do not become binding until we confirm them in a quote or agreement with you.

Submitting the contact form is an inquiry, not a booking. A photography session is scheduled only when we confirm it with you directly, and any session is subject to the terms we agree on at that time (including any separate service agreement). Aerial and drone photography is additionally subject to weather, airspace, and other operational conditions.

Photography is a creative and market-dependent service. While professional photos can help a listing attract attention, we do not guarantee any particular outcome from the use of our photographs — including that a property will sell or rent, or achieve any particular price or timeline. Nothing on the Site is real estate, financial, or professional advice.

5. Intellectual Property

All content on the Site — including the photographs and videos in our galleries, text, logos, graphics, and the design and layout of the Site itself — is owned by or licensed to Sweetie Pea, Inc. and is protected by copyright, trademark, and other intellectual property laws. Our portfolio photographs are our creative work; displaying them on the Site does not grant anyone a license to use them. We grant you a limited, revocable, non-transferable license to view the Site for your personal and business reference. You may not copy, download, reproduce, republish, scrape, distribute, or use any Site content — including any photograph — for any other purpose without our prior written permission. Rights to use photographs from a client engagement are governed by the license granted in that engagement, not by these Terms.

6. Acceptable Use

When using the Site, you agree that you will not:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to breach, probe, or test the security of the Site or any related systems
Use bots, scrapers, or other automated tools to access or harvest content or images from the Site
Interfere with the operation of the Site or the ability of others to use it
Impersonate any person or misrepresent your affiliation with anyone
Upload or transmit viruses, malware, or any other harmful code, including through file attachments submitted with the contact form

7. Site Content Is Informational Only

The content on the Site is general information provided for your convenience. Service descriptions, pricing, and availability may change at any time without notice, and we do not warrant that the information on the Site is current, complete, or error-free.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. IMAGES BY KRISTEN DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SWEETIE PEA, INC. DBA IMAGES BY KRISTEN AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE, THESE LIMITS APPLY TO THE FULLEST EXTENT THE LAW ALLOWS.

10. Indemnification

You agree to defend, indemnify, and hold harmless Sweetie Pea, Inc. dba Images by Kristen and its owners, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

11. Third-Party Links and Services

The Site may contain links to or embed content from third-party websites and services, including our Facebook and Instagram pages and GoDaddy (which powers the Site). We do not control those sites and services and are not responsible for their content, policies, or practices. If you use them, you do so at your own risk and under their own terms and privacy policies.

12. Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or harms Images by Kristen, our clients, or other Site visitors. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive termination.

13. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

14. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site (client photography engagements are governed by their own agreements). We may assign these Terms; you may not assign them without our written consent. Section headings are for convenience only.
